(the "Gifto") Throughout these Terms, "we", "us", "our", and "Gifto" refer to Gifto Canada Inc., its affiliates, and their employees, officers, directors, and representatives. Gifto offers this Website, including all information, tools, and services, conditioned upon your acceptance of all terms, conditions, policies, and notices stated herein.
By using our Website or purchasing any of Gifto's goods or services, you expressly agree to engage in our Website's "Service" and agree to be bound by these Terms of Use, including any additional terms, conditions, and policies referenced herein. These Terms apply to all users of the Website, including browsers, vendors, customers, merchants, clients, and contributors of content.

Although Gifto believes the information is correct at the time it is posted, Gifto does not warrant accuracy, completeness, or fitness for any purpose. Gifto neither warrants nor represents that your use of Content will not infringe rights of third parties.
Subject to these Terms, you are granted a limited license to display Content on the Website for personal, non-commercial use only. Content may not be modified, copied, reproduced, sold, or exploited without Gifto's prior written permission.
The Website may allow you to submit personal information. By doing so, you consent to its use for purposes related to the Website and Services. You warrant that you have all rights to submit the information and that it is free of viruses or malware. Gifto is not responsible for lost, intercepted, or altered communications.

Gifto is not responsible for interruptions, errors, or unavailability of services. Total liability to users shall not exceed the purchase price of the service or gift certificate purchased. Users agree to indemnify Gifto against claims arising from their use of the Website or Services.
You may only use the Website lawfully. Interfering with security, attempting unauthorized access, scraping, or using robots/spiders is prohibited. Gifto may suspend access if misuse is suspected.
Gifto does not control third-party websites and is not responsible for their content. Links do not imply endorsement.
Gifto is not liable for viruses or destructive programs affecting your device due to access or downloads from the Website. Antivirus software is recommended.
Gifto is incorporated in Alberta, Canada, and the Website is operated from Alberta. All matters relating to these Terms and Website access are governed by Alberta law, and disputes are resolved in the courts of Alberta, Calgary.
By providing your mobile phone number, you consent to receive SMS notifications regarding certificate delivery, booking confirmations, reminders, and service updates. Message/data rates may apply. Opt-out by replying STOP.
A purchaser may select up to five (5) services for a single gift certificate. The purchase price equals the highest-priced service selected. By purchasing a certificate, the purchaser agrees to all terms, including validity, refund, and exchange policies.
The recipient may redeem the certificate for one (1) service only, within the validity period and subject to availability. If the redeemed service is of lower value, no remaining balance or credit will be issued. Certificates cannot be redeemed for cash or combined with other offers unless expressly authorized. Validity: The certificate's expiration date is displayed on the payment page, at the time of activation, in the Email confirmation (for Digital Certificates), and inside the packaging (for physical gift boxes). In any case, the certificate cannot be valid for more than four (4) months from the date of purchase.
Refund is permitted within seven (7) days from purchase, provided:
Requests must be sent to support@gifto.ca. Refunds will be issued using the original payment method, less the cost of shipping, any branded packaging selected at the time of purchase, and a transaction fee of 2.9% + CAD 0.30 per transaction. Once the refund is approved, Gifto will deactivate the previously issued certificate, and it cannot be used to redeem the Service.
Refunds are not available after 7 days or if the above conditions are not met. Please note that exchanges are not permitted.
All payments on the Website are processed exclusively via Stripe. By making a payment, you agree to Stripe's Terms of Service and Privacy Policy. Gifto does not store, access, or process full payment card details and is not responsible for errors, delays, or disputes arising from Stripe.
All services purchased are provided by independent partner service providers. Gifto acts solely as a platform to facilitate purchase and redemption and is not responsible for quality, availability, scheduling, or fulfillment. Any claims regarding the service must be directed to the relevant provider.
Certificates and associated services are provided "as is". Gifto is not liable for cancellations, delays, or unavailability of services by partners. Total liability is limited to the purchase price of the certificate.
Personal information is collected for processing purchases, redemptions, booking confirmations, reminders, and service updates. SMS/email notifications may incur charges. Opt-out instructions are provided.
Certificates may not be sold, transferred for value, or misused. Tampering or fraud voids the certificate and may result in legal action. Certificates cannot be combined with other promotions unless explicitly authorized.
All matters relating to certificates are governed by Alberta law, and disputes are resolved in the courts of Alberta, Calgary. Purchasers waive class action rights.
Gifto is not liable for service unavailability due to circumstances beyond its control, including provider cancellations, technical failures, pandemics, or natural disasters. Services are subject to provider schedules and limitations.
